Curtea de Apel Bucure\u0219ti a respins, pe 20 decembrie, apelul \u00eenaintat de ELCEN \u00eempotriva deciziei judec\u0103torului sindic din mai care respinsese cererea de ie\u0219ire din insolven\u021b\u0103. Reprezentan\u021bii Electrocentrale au anun\u021bat c\u0103 au reu\u0219it s\u0103 acopere \u00een totalitate datoriile \u0219i c\u0103 vor relua procedura \u00een februarie 2023. Societ\u0103\u021bile aflate \u00een insolven\u021b\u0103 nu pot face investi\u021bii \u0219i nu pot accesa fonduri europene. <\/p>\n\n\n\n

Elcen a comunicat decizia instan\u021bei de la CAB, \u00eentr-un comunicat, pe pagina de Facebook. <\/p>\n\n\n\n

“Aceast\u0103 decizie consfin\u021be\u0219te practic Hot\u0103r\u00e2rea din luna mai 2022 a Judec\u0103torului Sindic prin care acesta a dispus respingerea cererii ELCEN de ie\u0219ire din insolven\u021b\u0103, motivat de faptul c\u0103 la acel moment, ELCEN mai avea pe rolul instan\u021bei dosare asociate procedurii de insolven\u021b\u0103, \u00eenc\u0103 nesolu\u021bionate”, a comunicat ELCEN. <\/p>\n\n\n\n

\u00cenchiderea procedurii de reorganizare judiciar\u0103 \u0219i, implicit, a procedurii de insolven\u021b\u0103 prevede stingerea tuturor obliga\u021biilor de plat\u0103 asumate prin planul de reorganizare \u0219i a crean\u021belor curente scadente. Reprezentan\u021bii ELCEN sus\u021bin c\u0103, \u00een acest moment, societatea nu mai are datorii \u0219i a solu\u021bionat \u0219i toate litigiile comerciale. <\/p>\n\n\n\n

“La acest moment, ELCEN a acoperit \u00een totalitate crean\u021bele datorate \u0219i a solu\u021bionat \u0219i finalizat toate litigiile aflate pe rolul instan\u021bei. \u00cen aceste condi\u021bii, la termenul urm\u0103tor de judecat\u0103 din procedura de insolven\u021b\u0103 – 02.02.2023, ELCEN va pune \u00een discu\u021bie Judec\u0103torului Sindic o nou\u0103 cerere de ie\u0219ire din insolven\u021b\u0103, av\u00e2nd toate condi\u021biile legale \u00eendeplinite pentru realizarea acestui demers”, conform comunicatului ELCEN.<\/p>\n\n\n\n

De ce e esen\u021bial\u0103 ie\u0219irea din insolven\u021b\u0103 a ELCEN?<\/strong><\/p>\n\n\n\n

Societ\u0103\u021bile aflate \u00een proces de reorganizare judiciar\u0103 nu pot face investi\u021bii \u0219i nici nu pot accesa fonduri europene. Iar ELCEN are nevoie urgent\u0103 de investi\u021bii majore. <\/p>\n\n\n\n

“Cu c\u00e2t se \u00eent\u00e2rzie mai mult investi\u021biile, cu at\u00e2t cresc riscurile producerii unor avarii majore, cu afectarea continuit\u0103\u021bii prest\u0103rii serviciului de alimentare cu ap\u0103 \u0219i c\u0103ldur\u0103 c\u0103tre locuitorii racorda\u021bi la sistemul centralizat de \u00eenc\u0103lzire. CET-urile ELCEN au nevoie urgent\u0103 de investi\u021bii pentru a fi surse de producere sigur\u0103, constant\u0103, eficient\u0103”, a comunicat ELCEN.<\/p>\n\n\n\n

Parte din blocajul financiar care a dus la insolven\u021ba ELCEN a fost provocat de Prim\u0103ria Capitalei care nu pl\u0103tit sau a pl\u0103tit cu mare \u00eent\u00e2rziere subven\u021bia pentru energia termic\u0103. <\/p>\n\n\n\n


“\u00cen acest moment, datoriile Termoenergetica fa\u021b\u0103 de ELCEN se ridic\u0103 la aproape 1 miliard de lei, mai precis: 970.176.047,42 lei, reprezent\u00e2nd contravaloarea energiei termice livrate de ELCEN pe perioada martie 2022-noiembrie 2022”, conform ELCEN.<\/p>\n\n\n\n

ELCEN a atras aten\u021bia asupra consecin\u021belor pe care le-ar avea lipsa investi\u021biilor nu doar la nivelul Capitalei ci pentru \u00eentreg Sistemul Energetic na\u021bional.<\/p>\n\n\n\n

“Cantitatea de energie electric\u0103 produs\u0103 de ELCEN \u0219i livrat\u0103 \u00een SEN nu ar mai fi disponibil\u0103, ceea ce ar conduce la dezechilibrarea \u0219i afectarea siguran\u021bei \u00een func\u021bionare a sistemului energetic na\u021bional.
Cantitatea de energie termic\u0103 produs\u0103 de ELCEN \u0219i livrat\u0103 \u00een sistemul de termoficare nu ar mai fi disponibil\u0103, ceea ce ar \u00eensemna lipsa apei calde \u0219i c\u0103ldurii pentru aproape 2 milioane de locuitori ai capitalei \u0219i c\u00e2teva mii de institu\u021bii publice”, a comunicat ELCEN.<\/p>\n\n\n\n
