Giurgiu).<\/strong><\/p>\n\n\n\n<p>\u00cen 22 aprilie, tot Buletin de Bucure\u0219ti a publicat r\u0103spunsul CNAIR la acest articol. Documentul spune c\u0103 traseul autostr\u0103zii nu va fi revizuit <strong><em>(1)<\/em><\/strong> \u201e\u00eentruc\u00e2t varianta actual\u0103 a fost stabilit\u0103 \u00een baza unei analize complexe realizate \u00een cadrul Studiului de Fezabilitate\u201d; <strong><em>(2)<\/em><\/strong> \u201e\u00een acest context, lucr\u0103rile de construc\u0163ie a drumului nu sunt de natur\u0103 s\u0103 afecteze integritatea monumentului istoric\u201d; <strong><em>(3)<\/em><\/strong> revizuirea traseului nu se justific\u0103 deoarece nu exist\u0103 \u201eelemente clare, obiective \u015fi fundamentate din punct de vedere tehnic, economic, social sau al altor aspecte relevante\u201d \u015fi <strong><em>(4)<\/em><\/strong> CNAIR a ac\u0163ionat \u00een virtutea principiului interesului na\u0163ional.<\/p>\n\n\n\n<p><strong>Aceste afirma\u0163ii ale CNAIR nu se verific\u0103. Dimpotriv\u0103, s-au s\u0103v\u00e2r\u015fit multiple \u00eenc\u0103lc\u0103ri ale legii, p\u00e2n\u0103 la nivel de infrac\u0163iune.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-1-alegerea-traseului-prin-cetatea-lui-burebista-s-a-facut-in-contra-interesului-national-si-cu-incalcarea-legii-penale\"><strong>1. Alegerea traseului prin cetatea lui Burebista s-a f\u0103cut \u00een contra interesului na\u0163ional \u015fi cu \u00eenc\u0103lcarea legii penale<\/strong><\/h2>\n\n\n\n<p><strong>CNAIR spune c\u0103 <\/strong>alegerea traseului s-a f\u0103cut printr-o analiz\u0103 complex\u0103, \u00een care, \u00eentr-o prim\u0103 etap\u0103 <em>\u201ese identific\u0103 mai multe variante de traseu (de obicei 3-4) pe baza studiilor preliminare \u0219i a cercet\u0103rilor din teren. Fiecare variant\u0103 este analizat\u0103 \u00een func\u021bie de o serie de criterii stabilite anterior\u201d, apoi<\/em> se aleg cele mai favorabile dou\u0103 variante \u015fi se face o \u201eanaliz\u0103 multicriterial\u0103 de traseu\u201d, din care rezult\u0103 traseul final.<\/p>\n\n\n\n<p><strong>R\u0102SPUNS: CNAIR trebuie s\u0103 explice <em>(1) <\/em>de ce, contrar legii, Cetatea geto-dacic\u0103 de la Pope\u015fti, declarat\u0103, cu scop de <u>conservare<\/u>, zon\u0103 protejat\u0103 de interes na\u0163ional (Legea 5\/2000), a fost omis\u0103 din analiza multicriterial\u0103 de traseu, de\u015fi \u2013 dac\u0103 era inclus\u0103 \u2013 se impunea modificarea traseului \u015fi <em>(2)<\/em> \u00een ce fel aceast\u0103 omisiune este \u00een interesul na\u0163ional?<\/strong><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pentru claritate:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Corelat cu legisla\u0163ia de protec\u0163ie a patrimoniului arheologic, la <em>elaborarea obiectivelor\/proiectelor de investi\u0163ii finan\u0163ate din fonduri publice<\/em>, legisla\u0163ia prevede c\u0103 <strong>din prima etap\u0103 a unui SF \u015fi continu\u00e2nd cu toate etapele de alegere a traseului, <\/strong>criteriile trebuie s\u0103 includ\u0103 <strong>\u201eexisten\u0163a unor monumente istorice\/de arhitectur\u0103 sau situri arheologice pe amplasament sau \u00een zona imediat \u00eenvecinat\u0103; existen\u0163a condi\u0163ion\u0103rilor specifice \u00een cazul existen\u0163ei unor zone protejate\u201d<\/strong> (HG nr. 907\/2016).<\/li>\n\n\n\n<li><strong>Situl arheologic Cetatea geto-dacic\u0103 de la Pope\u015fti nu este unul oarecare, ci este inclus \u00eentr-o list\u0103 special\u0103<\/strong>, stabilit\u0103 prin <em>Legea nr. 5\/2000<\/em>: <strong><em>monumente istorice<\/em><\/strong> <strong><em>de valoare na\u0163ional\u0103 <u>excep\u0163ional\u0103<\/u>, zone protejate de interes na\u0163ional, de utilitate public\u0103<\/em><\/strong>, \u201edeclarate ca atare pentru <strong><em>atingerea obiectivelor specifice de conservare<\/em><\/strong> a valorilor de patrimoniu\u201d (pentru sit, v. Anexa III, pozi\u0163ia 2.1.e.15). A\u015fadar, dac\u0103 \u00een cazul altor situri protec\u0163ia (\u00eempotriva distrugerii cauzate de lucr\u0103ri de construire) poate \u00eensemna s\u0103parea unei p\u0103r\u0163i sau a \u00eentregului sit, <strong><em>\u00een cazul Pope\u015fti-Argedava scopul principal al protec\u0163iei este conservarea <\/em><\/strong><em>(v. <\/em>\u015fi obliga\u0163ia statului de a asigura\u201e<strong><em>conservarea unor m\u0103rturii materiale care s\u0103 poat\u0103 fi studiate de c\u0103tre genera\u0163iile viitoare<\/em><\/strong>\u201d \u00een <em>Legea nr. 150 din 1997\/ Conven\u0163ia european\u0103 pentru protec\u0163ia patrimoniului arheologic<\/em>). Asta pentru c\u0103 s\u0103p\u0103tura arheologic\u0103 este inevitabil distructiv\u0103\/desfiin\u0163eaz\u0103 partea de sit pe care se face, iar, \u00een acela\u015fi timp, metodele de s\u0103p\u0103tur\u0103 se perfec\u0163ioneaz\u0103 continuu, cu accent pe metode nedistructive. Din aproape 3.000 de monumente istorice de grup\u0103 valoric\u0103 A (valoare na\u0163ional\u0103 \u015fi universal\u0103), <strong><em>numai 517 monumente de arhitectur\u0103 \u015fi 145 de monumente\/situri arheologice<\/em><\/strong> &#8211; acoperind cei peste 40.000 ani de c\u00e2nd exist\u0103 locuire uman\u0103 pe teritoriul Rom\u00e2niei &#8211; <strong><em>sunt incluse \u00een aceast\u0103 list\u0103.<\/em><\/strong><\/li>\n\n\n\n<li><strong><em>La \u00eenceputul SF exist\u0103 \u00eentotdeauna \u015fi un studiu arheologic preliminar. <\/em><\/strong>Acesta putea aduna date <strong><em>despre cetatea Pope\u015fti-Argedava <\/em><\/strong>din cel pu\u0163in<strong><em> 50 de publica\u0163ii dedicate<\/em><\/strong> (ap\u0103rute p\u00e2n\u0103 \u00een 2021 fiind, <em>de exemplu<\/em>, 14 publica\u0163ii de prof. Radu Vulpe, 8 de acad. Alexandru Vulpe, 20 de Nona Palinca\u015f, 2 de George Trohani etc.), alte <strong><em>lucr\u0103ri generale \u015fi compendii,<\/em><\/strong> <strong><em>Repertoriul arheologic na\u0163ional<\/em> <\/strong>\u015fi<em> <strong>Legea nr. 5\/2000<\/strong><\/em>, \u00een plus, exist\u00e2nd \u015fi <strong><em>posibilitatea de a contacta, pentru date, Institutul Na\u0163ional al Patrimoniului \u015fi Institutul de Arheologie \u201eVasile P\u00e2rvan\u201d<\/em><\/strong>, care cerceteaz\u0103 situl din 1954. \u00centr-adev\u0103r, CNAIR a semnalat corect, \u00een r\u0103spunsul la peti\u0163ia \u201cSalva\u0163i Cetatea geto-dacic\u0103 Argedava\u201d<em>,<\/em> <strong><em>neconcordan\u0163e \u00een documentele de urbanism<\/em><\/strong> (o problem\u0103 ce nu poate fi l\u0103murit\u0103 aici). Oricum, <strong><em><u>CNAIR nu a spus niciodat\u0103 c\u0103 nu ar fi putut localiza situl Pope\u015fti-Argedava, iar amplasarea acestuia<\/u><\/em><u> <em>\u00een ampriza autostr\u0103zii \u015fi \u00een imediata sa vecin\u0103tate<\/em><\/u><\/strong> este evident\u0103, mai ales c\u0103 <strong><em>partea de teren dintre Argedava \u015fi Arge\u015f ce poate fi utilizat\u0103 la construirea autostr\u0103zii este de sub 100 m<\/em><\/strong> (p\u00e2n\u0103 la albia mai veche a Arge\u015fului, cursul actual fiind unul recent &#8211; Evident, situl nu putea fi mutat, dar <strong>traseul autostr\u0103zii, fiind unul de c\u00e2mpie, putea fi modificat <\/strong>(\u015fi putea fi doar o modificare par\u0163ial\u0103, \u00eentre nodurile dela D\u0103r\u0103\u015fti-Ilfov \u015fi Mih\u0103ile\u015fti).<\/li>\n\n\n\n<li><strong><u>Omiterea sitului arheologic Pope\u015fti-Argedava din<\/u><\/strong> <strong>analiza multicriterial\u0103 pentru alegerea traseului<\/strong><strong> este o form\u0103 de \u00eempiedicare a \u201elu\u0103rii m\u0103surilor de conservare\u201d a unui bun cultural, ceea ce, conform <em>Codului penal<\/em>, <u>este infrac\u0163iune<\/u> <\/strong>(Art. 253).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-2-cnair-nu-a-luat-masuri-pentru-a-nu-afecta-integritatea-monumentului-cetatea-geto-dacica-argedava-dimpotriva\"><strong>2. CNAIR <u>NU<\/u> a luat m\u0103suri pentru a nu afecta integritatea monumentului <em>Cetatea geto-dacic\u0103 Argedava<\/em>. Dimpotriv\u0103!<\/strong><\/h2>\n\n\n\n<p><strong>CNAIR spune c\u0103 <\/strong>arheologii angaja\u0163i s\u0103 fac\u0103 diagnosticul intruziv (adic\u0103 testarea \u00een ad\u00e2ncime a terenului) au f\u0103cut dou\u0103 sec\u0163iuni pe traseul autostr\u0103zii (la <em>km 6+600 \u0219i km 6+150)<\/em> \u015fi au propus cercetare preventiv\u0103.<\/p>\n\n\n\n<p><em>\u201e<strong>Mai mult, suprafa\u021ba delimitat\u0103 \u00een coordonate Stereo 70, conform raportului arheologic, a fost extins\u0103 \u0219i \u00een afara traseului proiectului de infrastructur\u0103 pentru a preveni eventuale afect\u0103ri accidentale ale sitului. &nbsp;Aceasta a fost preluat\u0103 \u0219i \u00een Avizul nr. 11\/A\/09.02.2024, emis de Direc\u021bia Jude\u021bean\u0103 pentru Cultur\u0103 Giurgiu<\/strong><\/em>.<\/p>\n\n\n\n<p><em>\u00cen acest context, lucr\u0103rile de construc\u021bie a drumului nu sunt de natur\u0103 s\u0103 afecteze integritatea monumentului istoric \u0219i se vor derula \u00een zona de protec\u021bie a acestuia, \u00een lunca Arge\u0219ului, \u0219i nu la nivelul promontoriului pe care se afl\u0103 localizat acesta<\/em>\u201d, mai afirm\u0103 CNAIR\u00bb.<\/p>\n\n\n\n<p><strong>R\u0103spuns:<\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>Tradus pentru nespeciali\u015fti, ce spune CNAIR \u00eenseamn\u0103 c\u0103 lucr\u0103rile de construc\u0163ie a a autostr\u0103zii nu vor afecta integritatea a <u>ce va mai fi r\u0103mas din cetatea Argedava<\/u>, pentru c\u0103 la data \u00eenceperii construc\u0163iei o parte va fi fost desfiin\u0163at\u0103 prin s\u0103p\u0103tur\u0103 preventiv\u0103 cerut\u0103 de arheologii care au lucrat pentru CNAIR.<\/strong><\/p>\n\n\n\n<p><em>Adic\u0103<\/em>, arheologii angaja\u0163i pentru SF au g\u0103sit depunere arheologic\u0103 \u00een lunc\u0103, pe traseul autostr\u0103zii, \u015fi \u201epentru a preveni eventuale afect\u0103ri accidentale ale sitului\u201d au delimitat, cu coordonate Stereo 70, o arie de cercetat arheologic preventiv \u2013 cea din <em>Avizul DJC Giurgiu nr. 11\/A\/09.02.2024<\/em> (corectat\u0103 pentru eroare material\u0103, pentru c\u0103, din cauza unei gre\u015feli \u00een capul de tabel, ini\u0163ial coordonatele se proiectau \u00een jud. Bihor). <strong>3<\/strong>. noul perimetru al cet\u0103\u0163ii, dup\u0103 ce s-ar fi f\u0103cut s\u0103p\u0103tura preventiv\u0103.<\/figcaption><\/figure>\n\n\n\n<p>\u00ce<strong>n concluzie<\/strong>, suprafa\u0163a actual\u0103 a sitului Pope\u015fti-Argedava, a fost <strong><em>propus\u0103 de arheologii CNAIR spre a fi redus\u0103<\/em><\/strong> prin s\u0103p\u0103tura arheologic\u0103 preventiv\u0103 \u015fi <strong><em>\u201e\u00een acest context\u201d<\/em><\/strong>, ne spune CNAIR, lucr\u0103rile de construc\u0163ie nu vor afecta integritatea sitului care a mai r\u0103mas.<\/p>\n\n\n\n<p><strong>Totu\u015fi, acest dezastru NU se va \u00eent\u00e2mpla la aceste dimensiuni!<\/strong>&nbsp; Institutul de Arheologie \u201eVasile P\u00e2rvan\u201d a atras aten\u0163ia Ministerului Culturii c\u0103 \u2013 chiar dac\u0103 s-ar aproba vreodat\u0103 o s\u0103p\u0103tur\u0103 de asememena dimensiuni \u00een <strong><em>partea cea mai important\u0103<\/em><\/strong> &#8211; cartierul politico-administrativ &#8211; <strong><em>\u015fi mai bine p\u0103strat\u0103<\/em><\/strong> a sitului complex numit Cetatea Argedava, <strong><em>la standardele interna\u0163ionale actuale ar dura peste 100 de ani<\/em><\/strong> \u015fi ar necesita numai pentru s\u0103p\u0103tur\u0103 un num\u0103r de arheologi califica\u0163i ce nu sunt disponibili \u00een Rom\u00e2nia (l\u0103s\u00e2nd la o parte aspectele interdisciplinare). <\/p>\n\n\n\n<p>Ca urmare, Ministerul Culturii a redus suprafa\u021ba de s\u0103pat preventiv la traseul drumului.<\/p>\n\n\n\n<p><strong><em>De ce insist\u0103 CNAIR s\u0103 comunice public aceast\u0103 propunere ini\u0163ial\u0103 a sa?<\/em><\/strong> Consider\u0103 propunerile sale mai bune dec\u00e2t solu\u0163ia dat\u0103 de Ministerul Culturii? \u015ei ultima este un dezastru pentru monument, doar c\u0103 un dezastru mai redus ca suprafa\u0163\u0103 (v. mai jos).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>contrar afirma\u0163iilor cnair, exist\u0103 elemente clare, obiective\u201d pentru revizuirea traseului<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>CNAIR spune c\u0103<\/strong> nu exist\u0103 \u201eelemente clare, obiective \u015fi fundamentate din punct de vedere tehnic, economic, social sau al altor aspecte relevante pentru modificarea variantei de traseu\u201d.<\/p>\n\n\n\n<p><strong>R\u0103spuns:<\/strong> Publicul nespecialist ar putea crede totu\u015fi c\u0103, \u00een pofida repetatelor nerespect\u0103ri ale legii, fie \u015fi din pur\u0103 \u00eent\u00e2mplare, s-ar putea construi autostrada f\u0103r\u0103 daune importante pentru monumentul istoric de la Pope\u015fti. <\/p>\n\n\n\n<p>Din p\u0103cate, acest lucru nu este posibil: <strong>chiar cu modificarea ariei de s\u0103pat preventiv impus\u0103 de Ministerul Culturii <\/strong>(v. mai sus), <strong><em>(1)<\/em> traseul autostr\u0103zii \u00eencalc\u0103 legea care cere conservarea monumentului istoric \u00een cadrul s\u0103u natural \u015fi <em>(2)<\/em> cercetarea preventiv\u0103 impus\u0103 pe traseul autostr\u0103zii va cauza daune iremediabile sitului din lunca Arge\u015fului \u015fi a datelor privind evolu\u0163ia mediului natural \u015fi a interac\u0163iunii sale cu societ\u0103\u0163ile din trecut \u2013 o \u00eembinare care nu mai exist\u0103 nic\u0103ieri \u00een alt\u0103 parte, tocmai din cauza \u00eendelungatei locuiri a sitului (\u00eencep\u00e2nd cu acum aprox. 4600 de ani) \u015fi a rela\u0163iei sale cu Arge\u015ful.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-3-a-obligatia-legala-de-a-conserva-cetatea-de-la-popesti-in-cadrul-sau-natual\"><strong>3.<\/strong><strong>a. Nimic mai fals. <strong>La Stonehenge:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>nu exist\u0103 nicio autostrad\u0103<\/strong> (\u00een Marea Britanie autostr\u0103zile sunt notate cu litera M, de la \u201emotorway\u201d); drumurile invocate de CNAIR sunt de tip A \u015fi au numai c\u00e2te o band\u0103 pe sens, a\u015fa cum este \u015fi DJ 412 A, care trece prin Pope\u015fti;<\/li>\n\n\n\n<li>au fost <strong>dou\u0103 drumuri de tip A<\/strong>, dintre care unul, <strong>A344,<\/strong> a fost desfiin\u0163at \u00een 2013 (asfaltul a fost scos \u015fi terenul \u00eenierbat: <a href=\"https:\/\/en.wikipedia.org\/wiki\/A344_road_(England)\">https:\/\/en.wikipedia.org\/wiki\/A344_road_(England)<\/a> ), iar pentru cel\u0103lalt, <strong>A303<\/strong>, construit acum un secol peste un drum de p\u0103m\u00e2nt de acum dou\u0103 secole, <strong><em>se caut\u0103 solu\u0163ii de desfiin\u0163are chiar dac\u0103 din zona monumentului de piatr\u0103 poate fi v\u0103zut numai din anumite unghiuri,<\/em><\/strong> pentru c\u0103 din alte unghiuri se interpune valul din prima etap\u0103 a Stonehenge (cca. 3000 \u00ee.e.n.); vreme de trei decenii s-au f\u0103cut proiecte pentru un tunel (<a href=\"https:\/\/www.nationaltrust.org.uk\/who-we-are\/news\/stonehenge-a303-road-improvement-scheme\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.nationaltrust.org.uk\/who-we-are\/news\/stonehenge-a303-road-improvement-scheme<\/a> ), cu care o parte dintre cet\u0103\u0163eni nu au fost de acord. Restul sunt drumuri locale, de p\u0103m\u00e2nt.<\/figcaption><\/figure>\n\n\n\n<p>\u00cen cazul Argedavei \u015fi a Autostr\u0103zii Bucure\u015fti-Alexandria nici m\u0103car speran\u0163a unei demont\u0103ri viitoare, oric\u00e2t de costisitoare, nu este acceptabil\u0103, pentru c\u0103 <strong><em>lucr\u0103rile de fundare vor afecta iremediabil depunerile arheologice \u015fi naturale din ad\u00e2ncime<\/em><\/strong> (v. \u015fi mai jos).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-3-b-traseul-autostrazii-si-integritatea-sitului-din-lunca-argesului\"><strong>3.b. Traseul Autostr\u0103zii \u015fi integritatea sitului din lunca Arge\u015fului<\/strong><\/h2>\n\n\n\n<p>Din mai multe cauze, limitele exacte ale siturilor arheologice nu se cunosc cu precizie aproape niciodat\u0103 (nic\u0103ieri \u00een lume, nu numai \u00een Rom\u00e2nia). \u00cen consecin\u0163\u0103, <strong><em>unul dintre rolurile zonei de protec\u0163ie este s\u0103 asigure \u00eempotriva distrugerii posibile <\/em><\/strong>a unei depuneri arheologice neincluse \u00een perimetrul siturilor pentru c\u0103 fie depunerea <strong><em>(1) era necunoscut\u0103 p\u00e2n\u0103 la data interven\u0163iei \u00een teren, fie (2) existen\u0163a sa era dedus\u0103 din analiza altor date, dar depunerea ca atare nu era vizibil\u0103 la suprafa\u0163a terenului, deci nu putea fi delimitat\u0103 topografic \u015fi inclus\u0103 \u00een limitele sitului<\/em><\/strong>. <\/p>\n\n\n\n<p>De aceea, legea oblig\u0103 <strong><em>\u00eentotdeauna la<\/em><\/strong> <strong><em>supraveghere arheologic\u0103 <\/em><\/strong>(indiferent de m\u0103rimea interven\u0163iei \u00een sol) sau la <strong><em>diagnostic intruziv<\/em><\/strong>, dup\u0103 caz.<\/p>\n\n\n\n<p>La Pope\u015fti, \u00een zona dintre cetate \u015fi Lunca Arge\u015fului se \u015ftia din literatura de specialitate c\u0103 exist\u0103 depunere arheologic\u0103 acoperit\u0103 de \u015fi intercalat\u0103 cu aluviuni rezultate din episoade climatice de intensitate diferit\u0103, inclusiv inunda\u0163ii de amploare excep\u0163ional\u0103 (de ex., V. Boronean\u0163, \u201e<a href=\"https:\/\/cab.muzeulbucurestiului.ro\/fisiere\/06-Cercetari-Arheologice-in-Bucuresti-VI-2005_013.pdf\" type=\"link\" id=\"https:\/\/cab.muzeulbucurestiului.ro\/fisiere\/06-Cercetari-Arheologice-in-Bucuresti-VI-2005_013.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Considera\u0163ii privind p\u0103durea \u00eengropat\u0103 din Bazinul Arge\u015fului inferior<\/a>\u201d, \u00een <em>Cercet\u0103ri arheologice \u00een Bucure\u015fti<\/em> 6, 2005). <\/p>\n\n\n\n<p>Ce nu se \u015ftia erau limitele acesteia, de aceea a r\u0103mas \u00een zona de protec\u0163ie. Arheologii care au lucrat la SF au descoperit\/confirmat datele pre-existente prin identificarea unor urme de activitate uman\u0103 sub ultimul strat de aluviuni, respectiv <strong>au descoperit continuarea sitului Pope\u015fti-Argedava \u2013 chiar dac\u0103 a unei <em>etape mai recente<\/em> a sa &#8211; dincolo de limitele \u00eenregistrate \u00een <em>Repertoriul arheologic na\u0163ional<\/em> \u015fi ar fi trebuit s\u0103 recomande modificarea traseului \u00een sensul evit\u0103rii zonei, pentru c\u0103 altfel traseul va trece prin sit<\/strong>. <\/p>\n\n\n\n<p>Au recomandat \u00eens\u0103 cercetare preventiv\u0103, ca \u015fi cum ar fi fost un sit oarecare.
